Terms and Conditions for Sennheiser e835 Virtual Tour Contest

0. Sponsor & Administrator 

This contest (the “Contest”) is administered by Performer Magazine (“Administrator”) and sponsored by Sennheiser Electronic Corporation (“Sponsor”). Sponsor is providing prize support and promotional visibility for the Contest; however, this promotional contest belongs to the Administrator and all matters regarding the collection of entries, selection of finalists, public voting, winner notification, prize fulfillment, and overall administration of the Contest are the sole responsibility of the Administrator. Any questions regarding the Contest should be directed to the Administrator, not the Sponsor. 

1. Eligibility 

This contest does not require a purchase and is open only to legal residents of the fifty (50) United States of America who are at least eighteen (18) years of age at the time of entry. Entrants must not be signed to a major record label or a large independent label. (Independent artists releasing music on their own or through small independent labels are eligible, but any affiliation with a label must be disclosed when entering and will be determined eligible solely by Administrator.) 

Contest is strictly limited to those who are legal residents of the 50 United States of America, and prizes will only be shipped to the 50 states. Unfortunately, and regrettably at this time the contest excludes all U.S. territories including but not limited to Puerto Rico, Guam, U.S. Virgin Islands, etcetera. 

Employees, officers, and representatives of Sennheiser, Performer Magazine, their affiliates, subsidiaries, advertising and promotion agencies, and immediate family members are not eligible to enter or win. The contest is void where prohibited by law. 

2. Agreement to Rules: By participating, you agree to be fully unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of the Administrator Performer Publishing LLC as final and binding as it relates to the content. The Contest is subject to all applicable federal, state and local laws. 

3. Contest Period:  

  • “Round of 10 Finalists” entries will be accepted online starting on or about October 16, 2025, and ending November 30, 2025, or until all winners have been selected at the sole discretion of the Administrator. All online entries must be received by November 30, 2025, 11:59PM EST.  
  • “Grand Prize Round” will be a voting mechanism as defined below and will commence on or around January 1, 2026, and ending on or around January 15, 2026

4. How to Enter 

The Contest must be entered by submitting an entry using the online form provided on this Contest site, located at www.performermag.com/xxx. The entry must fulfill all Contest requirements, as specified, to be eligible to win a prize which will include artists submitting one (1) original song by providing a link to a publicly accessible streaming platform (such as YouTube, SoundCloud, Bandcamp, etc.) through the contest entry form. Entries that are not complete or do not adhere to the rules or specifications may be disqualified at the sole discretion of the Administrator, Performer Publishing LLC. You may enter only once, and you must fill in the information requested. You may not enter more times than indicated by using multiple email addresses, identities or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules your submission may be removed from eligibility at the sole discretion of the Administrator, Performer Publishing LLC. 

  • Only one entry per artist is permitted. 
  • The submitted song must be 100% original and must not include covers, samples, or un-cleared material. 
  • By entering, artists confirm they own the rights to their submitted song and grant the Sponsor and Administrator a limited license to use the song in contest-related promotions, including background music in promotional videos. In good faith, artists will be notified and consulted on usage of song, name and likeness. Artists retain full ownership of their songs. 

5. Selection of the “Round of 10 Finalists” 

Winner selection and notification: A panel of judges from Performer Magazine, which may include employees of Sennheiser, will review all eligible entries. 10 “finalists” will be selected on skill-based criteria under the supervision of the Administrator based on the criteria below. Winners will be notified via the email address they used to enter the contest within five (5) days following the winning finalist selection. Entrants also can enter a phone number when entering the contest and Administrator will reach out to that number with one call and one text message with the notification. Performer Publishing LLC or Sponsor shall have no liability for a winner’s failure to receive notices due to any reason including but not limited to winners’ spam, junk e-mail or any other security settings or for winners’ provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within 72 hours from the time award notification was sent, or fails to timely return a completed and executed declaration and releases as required, prize may be forfeited, and an alternate winning finalist will be selected (please also see “Winner Notification” section below).  

  • Ten (10) “Round of 10 Finalists” will be selected based on songwriting, originality, musical performance, overall potential, overall presentation and suitability for the nature of the promotion. 
  • The judging panel’s decisions are final and made at the Administrator’s sole discretion. 
  • Finalists will be contacted via the email address they submitted when entering the contest, and if they entered a phone number the Administrator will use that number as a backup attempt for the notification. 
  • Each finalist will be awarded a Finalist Prize Package consisting of: 
  • At least three (3) Sennheiser e 835 Microphones 
  • At least one (1) Sennheiser HD 200 Pro Headphone 
  • *Each artist may have a different quantity depending on needs. 
  • Approximate Retail Value (ARV) of each finalist package: [$350 USD Value]

6. Round of 10 Finalists Video Submission for “Grand Prize Round”   

Each finalist will be required to record a live performance video of their submitted song using the microphones (and headphones if needed) provided in the 10 Finalist Round Prize Package. 

  • Finalists are solely responsible for producing and submitting their video. Administrator and Sponsor are not responsible for video quality, missed deadlines, or technical issues. 
  • The video must clearly showcase the use of the Sennheiser microphones (and headphones if applicable) provided by Sennheiser in a live performance. 
  • Live performance does not need to be in a venue or in front of a live audience and can be created in any environment. A great performance and the best showcase of the artists’ song is the most important factor. 
  • Microphones and Headphones manufactured by other manufacturers other than Sennheiser are not permitted in the video submissions. 
  • Finalist videos will be featured on a dedicated YouTube playlist created by the Administrator and linked to on the “Fan Voting Page” at www.performermag.com

7. “Grand Prize Round” of Public Voting 

  • The videos from the artists in the “Round of 10 Finalists” will be released onto a YouTube playlist with a cadence of two at a time and approximately every 2 weeks at the sole discretion of the Administrator. 
  • Once all videos have been released to the public, voting will take place on, or around January 1, 2026, through January 15, 2026, for a period of 2 weeks. 
  • The finalist whose video receives the most valid public votes during this period will be declared the Grand Prize Winner
  • In the event of a tie, a one-day tiebreaker vote will be held at the discretion of the Administrator. 
  • The Administrator reserves the right to disqualify fraudulent votes or voting activity that undermines the fairness of the contest. 

More detailed information on public voting: NO PURCHASE NECESSARY. Voting for the 2025 e835 Virtual Tour Contest Winners is conducted by the Administrator Performer Publishing LLC. During the Voting Period, you can vote by: 

Visiting www.performermag.com (the “Fan Vote Page”) and following the links and instructions at such webpage to complete (in its entirety) and submit electronically to vote. 

From the Fan Vote Page, you can view the list of artists eligible to be considered in the Fan Vote. To be eligible to cast a vote in the Fan Vote ballot, a user must: (1) Be 18 years of age at the time of voting; (2) Have met all other eligibility requirements as determined by Sponsors. In the event the voter does not meet these requirements, or attempts to tamper with the voting procedure in any way, their vote may be invalidated at the sole discretion of the Sponsors.  

Rules for voting in the “Grand Prize Round” to determine the grand prize winner: 

  • Fans of each artist will select the ‘vote’ button for that artist on the Fan Vote page.  
  • Fans may vote for one (1) eligible artist per ballot submission.  
  • Fans may submit 1 (one) ballot per 24 hours per unique email address (i.e., 12:00:00 AM ET to 11:59:59 PM ET) (each ballot submission is a “Vote”).  

Entries generated by script, macro or other automated means may be void. The use of multiple name variations or other methods to create additional votes by a single individual during any one (1) day period is prohibited. Violation of these terms and conditions may result in disqualification of the Vote from the Fan Vote as determined by Administrator.  

Voting Results 

Voting ends on 11:59:59 PM Eastern Time on January 15, 2026. The eligible artist who receives the most qualified and valid Votes during the “Round of 10 Finalists”, as determined by the Administrator in their sole discretion based on contest criteria, will earn a Sennheiser Prize Package (products and total value listed below by Sponsors). The Fan Vote grand prize winner will be notified within 7 business days following the completion of the voting application period and publicly announced on both www.performermag.com, www.sennheiser.com, and also may be listed in various other media outlets to be determined.   

8. Prizes 

  • Finalist Prizes (10 total): Each finalist will receive at least three (3) Sennheiser e 835 Microphones and three (1) pair of Sennheiser HD 200 Pro Headphones. (Retail Value: $350) 
  • Grand Prize (1 total): The finalist with the most public votes will receive a recording and live performance gear package valued at over $5,000 MSRP. (Full itemized list of gear below the Terms & Conditions.) 

All prizes are non-transferable and may not be substituted for cash. Sponsor will cover shipping costs for all prizes. If applicable, winners are responsible for identifying and paying any and all taxes associated with prize acceptance, including the issuance of a 1099 tax form for prizes valued at $600 or more.  Contest is strictly limited to those who are legal residents of the 50 United States of America, and prizes will only be shipped to the 50 states. Unfortunately, and regrettably at this time the contest excludes all U.S. territories such as but not limited Puerto Rico, Guam, U.S. Virgin Islands. 

9. Winner Notification 

  • The winners of the “Round of 10 Finalists” will be notified by email (and by phone number if one was submitted) as they are selected by the sole discretion of the Administrator.  
  • Finalists must confirm acceptance of their prize and agree to produce their live performance video by the stated deadline (to be provided at time of finalist notification). 
  • The winner of the “Grand Prize Round” will be notified and announced on or about January 20, 2026, and will also be featured on the websites of Sennheiser and Performer Magazine. 
  • Winners may be required to sign and return an affidavit of eligibility, liability release, and publicity release as a condition of prize acceptance. 
  • Artists who are not selected will not receive a notification from the Administrator.Shape 

10. Rights & Publicity 

By entering, participants grant the Administrator and Sponsor permission to use their name, likeness, and submitted materials (song and video) for promotional purposes in connection with the contest, in any media, worldwide, without additional compensation, unless prohibited by law. The Administrator will, in good faith, consult with the artists on PR opportunities.  

Artists retain all rights to their songs. 

11. Disqualification 

The Administrator reserves the right to disqualify any entry or finalist found to: 

  • Submit incomplete or non-original content 
  • Fail to meet deadlines 
  • Engage in inappropriate, infringing, or fraudulent conduct 
  • Manipulate or attempt to manipulate the public voting process 

12. Limitation of Liability 

By participating, entrants agree to release, discharge, indemnify, and hold harmless the Sponsor, Administrator, and their respective parent companies, affiliates, subsidiaries, officers, directors, employees, agents, and representatives from any and all claims, liabilities, damages, losses, costs, or any and all expenses arising out of or related to participation in the Contest, the acceptance, possession, use, or misuse of any prize, or any other activity related to the Contest. 

13. Governing Law 

The contest is governed by the laws of the United States of America and the state of Rhode Island.  

Additional Terms 

The Administrator reserves the right to void suspect entries, or to modify, cancel, or suspend part or all of the Fan Vote should virus, bugs, non-authorized human intervention or other causes beyond the control of the Administrator, corrupt or impair the administration, security, fairness or proper play of the Fan Vote. If cancelled or terminated early, the Administrator will determine the eligible artist(s) receiving the most Votes by tallying the Votes that the Administrator finds to be valid at the time of termination or cancellation. If suspended, the Administrator will determine the artist receiving the most Votes by tallying the Votes that the Administrator finds to be valid at the time of suspension and the Votes accumulated when voting resumes. The Administrator may prohibit a participant from taking part in the Fan Vote or disqualify a participant’s vote if it determines that said participant is attempting to undermine the legitimate operation of the Fan Vote by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, or threaten any other participant or representatives of the Administrator and/or Sponsors. The Administrator assume no responsibility for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, including, but not limited to, computer equipment, software, failure of any entry to be received by the Administrator on account of technical problems or traffic congestion on the Internet or at any web site, any combination thereof, or otherwise, whether caused by the Administrator, participants, or by any of the equipment or programming associated with or utilized in the promotion or by any technical or human error which may occur in the processing of submissions which may damage a user’s system or limit a participant’s ability to participate in the promotion. Rules and procedures are subject to change at the sole discretion of the Administrator without notice. All personally-identifiable information provided during the voting process will be treated in accordance with the privacy policy posted here: https://www.performermag.com. By participating in this Fan Vote, you agree to these terms and conditions, the applicable privacy policies, and the decisions of the Administrator and Sponsors, which decisions shall be final and legally binding in all respects. 

Caution – any attempt to deliberately damage the fan vote page or undermine the legitimate operation of the fan vote page, the website, or voting may be in violation of criminal and civil laws. Should such an attempt be made, Administrator reserves the right to seek remedies and damages (including attorneys’ fees) from any perpetrator of such acts to the fullest extent of the law, including criminal prosecution.
